Contractor profile

The MUNICIPAL ECONOMIC DEVELOPMENT COMPANY OF TARRAGONA, SA (EMDET SA) is a commercial company owned by Tarragona City Council.

As a municipal public company, EMDET SA is integrated into the definition of “public sector” established in section d) of art. 3.1 of Law 9/2017, of 8 November, on Public Sector Contracts, which transposes the Directives of the European Parliament and of the Council 2014/23 / EU and 2014/24 / EU into Spanish law, of February 26, 2014 (hereinafter LCSP).

In this sense, EMDET SA is in an intermediate stage of subjection to the LCSP according to its double condition of being a contracting authority not a Public Administration, in accordance with the provisions of art. 3.3 of the LCSP.

Consequently, in the award of contracts subject to harmonized regulation, EMDET SA will be subject to the provisions of the LCSP and in particular to the rules established in Sections 1 and 2 of Chapter I of Title I of Book II, as established Article 317. In the award of contracts not subject to harmonized regulation, EMDET SA in accordance with Article 318 LCSP, shall be subject, depending on the estimated value of the contract, to the same article or section 2a of Chapter I of the Title I of Book II of the LCSP. Likewise, in both harmonized and non-harmonized contracting, EMDET SA will sign private contracts with its successful bidders, in accordance with the provisions of article 26 LCSP.

The administrative restraint court order will be competent to know the issues of the preparation and award of contracts signed by EMDET SA, as well as the challenge of their modifications, if it is based on non-compliance with what is 'establishes in articles 204 and 205 of the LCSP, when it is understood that this modification had to be the subject of a new award. On the other hand, the civil court will be competent to understand the disputes that arise between the parties in relation to the effects and termination of the private contracts signed by the entity, with the exception of the contractual modifications mentioned above.
